Oppo and Realme Users File Charges Against Pre-Installed Loan Apps

Background of the Controversy

Users of Oppo and Realme smartphones have initiated legal action against the companies for pre-installing loan applications on their devices without proper consent. This issue has raised significant concerns regarding data privacy and consumer rights, prompting a response from regulatory authorities.

Admission of Wrongdoing by Manufacturers

Both Oppo and Realme have acknowledged that they pre-installed the Fineasy and Happiness Loan apps on their smartphones without obtaining necessary approvals from the Bank of Thailand (BOT). This admission came during a meeting with the National Broadcasting and Telecommunications Commission (NBTC) on January 12, 2025. The brands have committed to ceasing the sale of affected devices and ensuring that future models will not include such applications.

Regulatory Response and Investigations

The NBTC has mandated that both companies withdraw devices featuring these loan apps from the market immediately. Additionally, the Personal Data Protection Committee has requested a comprehensive report detailing the personal data collected through these applications by January 16, 2025. The committee is concerned about potential violations of privacy regulations, as users reported that these apps could access sensitive personal information without their consent.

Consumer Council’s Involvement

The Thailand Consumers Council (TCC) has expressed dissatisfaction with the companies’ handling of the situation. They are preparing to file a class-action lawsuit against Oppo and Realme, citing inadequate transparency regarding the developers of the loan apps. The council emphasizes that this case highlights broader issues related to illegal lending practices in Thailand.

Social Media Backlash and Public Sentiment

The controversy has sparked significant public outcry, with social media campaigns like #OPPOFighting trending as employees attempt to defend the brand. However, many users remain skeptical about the companies’ commitment to consumer safety, leading to calls for stricter regulations on pre-installed applications in smartphones.

Ongoing Investigations and Future Implications

As investigations continue into the practices of Oppo and Realme, both companies face potential legal repercussions for violating consumer protection laws. The outcome of these proceedings may set a precedent for how smartphone manufacturers handle third-party applications in the future, ensuring greater accountability and transparency in consumer dealings.
